Let's GO Transfer

Let's GO Driver Agreement

Last updated: 29/10/2026

Terms for licensed transport providers, and for the drivers who drive for them

Edition 1. Effective from 29 October 2026.

In brief (this summary is for convenience; the sections below are what bind):

  • Let's GO puts licensed carriers in touch with customers who want a transfer. It does not transport anyone and does not employ drivers.
  • The Carrier is an independent business. It decides whether and when to work, accepts or declines each order freely, and is free to work for anyone else at the same time.
  • When the Carrier accepts an order, Let's GO concludes the contract of carriage in the Carrier's name, collects the Carrier's price in the Carrier's name, and issues and sends the Carrier's invoice to the customer.
  • The customer pays one price made up of the Carrier's price and the Let's GO commission (Annex 1). The Carrier receives its price in full. The Let's GO commission is Let's GO's own fee, which Let's GO invoices to the customer itself; the Carrier pays Let's GO nothing.
  • The Carrier alone is responsible for its transport licence, driving licences, insurance, vehicles, taxes, social security and its own employees.
  • Registration, documents, acceptance of this Agreement and orders are done in the Driver App. Invoices are sent by e-mail, and payouts are made through the Payment Provider.

1. The parties and what this Agreement covers

1.1. Let's GO. The Let's GO service is operated by VIKI KIMO PRO, S.L., NIF B75955716, registered in the Registro Mercantil de Barcelona, sheet B-632101 ("Let's GO"). Registered office: Avenida 348, nº 36, 1º, 08860 Castelldefels, Barcelona, Spain. Office: Carrer de Vilamarí, 60, 08015 Barcelona, Spain. E-mail: info@letsgo-transfer.com. Telephone: +34 646 75 15 29.

1.2. The Carrier. The natural person or company that holds a Transport Licence, has registered in the Driver App and has accepted this Agreement (the "Carrier").

1.3. Definitions. In this Agreement:

  • "Transport Licence" means the authorisation, licence or registration that the law of the country where a trip takes place requires in order to carry passengers for hire in a vehicle with a driver. The Country Terms say what it is in each country; in Spain it is the VTC authorisation.
  • "Country Terms" means the terms in Annex 4 for each country where Let's GO offers orders.
  • "Driver" means a natural person who drives trips for a Carrier using the Driver App: the Carrier itself, where the Carrier is an individual who drives, or a person the Carrier employs.
  • "Customer" means whoever books and pays for a trip through Let's GO: a passenger, a hotel or other business booking for its guests, or a business partner booking for travellers. "Passenger" means the person who travels.
  • "Order" means a request for carriage offered to the Carrier through the Driver App. "Booking" means an order for a pickup at a later date. "Trip" means the carriage the Carrier performs under an accepted order.
  • "Price" means the total amount the Customer pays for a trip, taxes included, including the extras booked and any cancellation fee, no-show charge or waiting time the Customer owes under the Passenger Terms. It is made up of the Carrier's price and the Let's GO commission.
  • "Carrier's price" means the part of the Price that is the consideration for the carriage, as set out in Annex 1. It is invoiced in the Carrier's name and paid to the Carrier in full.
  • "Let's GO commission" means the part of the Price that is Let's GO's fee for its own service to the Customer, as set out in Annex 1. Let's GO invoices it to the Customer in its own name.
  • "Payment Provider" means the payment institution, electronic money institution or bank, authorised under the law that applies to it, that Let's GO engages from time to time to accept Customers' payments and to pay Carriers. The Driver App names the Payment Provider in use.
  • "Payout account" means the account in the Carrier's name, held with or registered through the Payment Provider, into which the Carrier's price is paid.
  • "Driver App" means the Let's GO Driver mobile application and any other tool Let's GO makes available to Carriers and Drivers. "Service" means the online intermediation service described in section 2.
  • "Registration" means the steps in the Driver App by which a Carrier or a Driver gives the information and documents in Annex 3 and the Country Terms.
  • "Passenger Terms" means the Let's GO Terms of Use that Customers accept.
  • "Durable medium" means an e-mail to the address registered in the Driver App, or any other means that lets the Carrier store the information and reproduce it unchanged.

1.4. Scope. This Agreement governs the Carrier's use of the Service and the mandates the Carrier gives Let's GO. It does not govern the contract of carriage itself, which is between the Carrier and the Customer.

1.5. Who may accept it. Only a holder of a Transport Licence may accept this Agreement as a Carrier. A person employed by a Carrier cannot accept it on their own account: they register as that Carrier's Driver under section 14.

1.6. Acceptance, without signatures or meetings. This Agreement is concluded electronically. The Carrier accepts it in the Driver App at Registration, and again before going online after a new edition takes effect. No paper signature and no meeting is needed. Let's GO records which edition was accepted, in which language, from which device and when, together with the answers and documents given at Registration, and keeps this Agreement available in the Driver App and on its website. Because both parties act as businesses, they agree that the information and confirmation duties that the law allows businesses to exclude in contracts concluded electronically (articles 10(1), 10(2) and 11(1) of Directive 2000/31/EC and the national rules implementing them) do not apply.

1.7. Countries. The body of this Agreement applies in every country. Let's GO offers orders only in the countries that have Country Terms in Annex 4. For trips in a country, its Country Terms apply as well and prevail over the body of this Agreement where they differ.

2. What Let's GO does, and what it does not do

2.1. The Service. Let's GO provides an online intermediation service: it receives requests from Customers, calculates and shows the Price, offers orders to Carriers, and, in the Carrier's name and on its behalf, concludes the contract of carriage, collects the Carrier's price and issues the Carrier's invoice. For its own service to the Customer, Let's GO charges the Let's GO commission in its own name. It also provides the Driver App with navigation to the pickup, contact with the Passenger, the trip's details, and the Carrier's earnings history; invoices are sent to the Carrier by e-mail.

2.2. What Let's GO is not. Let's GO is not a carrier. It does not perform carriage, does not hold Transport Licences for the trips offered through the Service, does not employ Drivers, and does not offer carriage itself or through any company it controls.

2.3. An independent business relationship. The Carrier provides its services as an independent business, in its own name and at its own risk. This Agreement is a commercial contract between two businesses. It creates no employment relationship between Let's GO and the Carrier or any Driver, and no partnership or joint venture. Nothing in it gives Let's GO a power to direct how the Carrier organises its work or to discipline the Carrier or its Drivers. The information Let's GO passes on about a trip - the address, the time, the Passenger's name, a message from the Customer - describes what the Customer has booked; it is not an instruction on how to work.

2.4. Not an agency contract. Let's GO does not undertake to promote the Carrier's business on a stable basis and acts under the mandates in sections 6 and 7 only for the orders the Carrier accepts. The parties do not intend this Agreement to be a commercial agency contract within the meaning of Directive 86/653/EEC and the national laws implementing it.

2.5. Economic independence. The Carrier declares that it does not depend economically on Let's GO, and makes the further declarations the Country Terms require.

2.6. Where orders come from. Let's GO offers the Carrier's carriage on its website and in its apps, and through hotels, businesses and partners that book through Let's GO's tools. The Carrier's price and these terms are the same whichever of these channels an order comes from.

3. The Carrier's freedom to organise its work

3.1. When to work. The Carrier and its Drivers decide whether, when, for how long and where to be online. There are no schedules, no minimum hours, no minimum number of orders and no minimum acceptance rate.

3.2. Accepting and declining. The Carrier is free to accept or decline any order. Declining is not a breach, carries no charge, and Let's GO does not use declines to restrict the Carrier's access or reduce the orders offered to it.

3.3. No exclusivity. The Carrier may at any time carry passengers for its own customers, through other intermediaries or apps, or in any other way, including on the same day and while online in the Driver App, provided it does not accept orders it cannot perform. This Agreement does not restrict the prices or conditions the Carrier offers anywhere else.

3.4. Its own means. The Carrier provides, at its own cost and risk, the vehicles, the Transport Licences, the fuel, the maintenance, the insurance, the mobile telephones and data, and everything else needed to perform trips.

3.5. Its own organisation. The Carrier organises its own business: it may employ Drivers, decide which of its registered Drivers and vehicles work, and choose the route, subject to the addresses and stops of the booking and to the law.

3.6. No branding or uniform. Let's GO does not require the Carrier or its Drivers to wear a uniform or to display Let's GO's name or logo on the vehicle.

3.7. No guarantee of work. Let's GO does not guarantee any number of orders or any level of income.

3.8. The price. Let's GO calculates the Price offered to the Customer on the basis of the route between the addresses, the expected journey time, the car class and the extras booked (for a car with a driver by the hour or by the day, on the basis of the hourly or daily price of the car class and the time booked), and splits it into the Carrier's price and the Let's GO commission as Annex 1 provides. Each offer shows the Carrier's price before the Carrier decides; a Driver employed by a Carrier may be shown the order without the amount. The Carrier authorises Let's GO to quote the Carrier's price to Customers in its name on that basis; a contract of carriage at the Carrier's price shown is concluded in the Carrier's name only if and when the Carrier accepts the order.

4. Licences, insurance and the Carrier's other legal obligations

4.1. The Carrier's warranties. The Carrier warrants, when it accepts this Agreement and throughout its term, that:

  • (a) it holds a valid Transport Licence for each vehicle it uses for trips, issued by the competent authority, and complies with every condition attached to it, including any rules on where services must mainly be provided, on contracting services in advance, on registering or communicating each service, and on the documents that must be carried in the vehicle;
  • (b) each Driver holds a valid driving licence of the class required and any professional qualification or permit that the State, the region, the municipality, an airport or a port requires;
  • (c) each vehicle is registered, has passed its periodic roadworthiness inspection within the required period, and is covered by the compulsory motor insurance, by any compulsory insurance for passengers carried for hire, and by civil liability insurance covering Passengers and third parties at least up to the amounts the law requires;
  • (d) it is registered with the tax authority for the activity it carries out, and registered with and up to date in its payments to social security, as a self-employed person or as an employer;
  • (e) every Driver it employs is employed and registered with social security as the law requires, and it pays their wages, contributions and taxes;
  • (f) it and each Driver have the right to work in the country where they perform trips;
  • (g) everything it declares at Registration and afterwards is true and complete;

and it meets the specific requirements listed in the Country Terms.

4.2. Responsibility stays with the Carrier. The Carrier alone is responsible for obtaining, keeping, renewing and complying with the licences, permits, insurance and registrations in section 4.1, and for the consequences of lacking any of them. Let's GO reviews documents for its own purposes: that review does not transfer any of this responsibility to Let's GO and does not confirm that the Carrier complies with the law.

4.3. Registration. The Carrier gives the information and uploads the documents listed in Annex 3 and in the Country Terms at Registration in the Driver App. No order is offered until Let's GO has reviewed them. Where the Driver App does not yet ask for an item, the Carrier sends it to info@letsgo-transfer.com.

4.4. Keeping it current. The Carrier uploads a renewed document before the old one expires, and tells Let's GO in the Driver App or by e-mail within 24 hours if any Transport Licence, driving licence, inspection or insurance is suspended, revoked, expires or stops covering trips, or if any information given at Registration changes.

4.5. Missing or expired documents. Let's GO may stop offering orders to a Carrier, a Driver or a vehicle whose document is missing, expired or in doubt, until the matter is resolved, and tells the Carrier why under section 13.

4.6. The law of carriage. The Carrier complies with all rules that apply to the trips it performs: transport, traffic and road safety, consumer protection, tax, employment, data protection, equal treatment and accessibility, including the carriage of assistance dogs, and any regional or local rules, including keeping official complaint forms available to Passengers where consumer rules require it. The Carrier bears any fine or sanction imposed for its trips.

5. Orders and trips

5.1. How orders are offered. Orders reach Carriers through the Driver App as described in Annex 2. Where needed, a Let's GO dispatcher may also assign an order to a Driver directly, replace the Driver of an order, or change an order, for example at a Customer's request or so that a trip is not missed. The Driver is told in the Driver App. A Driver who cannot perform an order assigned or changed this way may return it in the Driver App or tell Let's GO, and doing so is not a breach.

5.2. What an offer shows. Before accepting, the Carrier sees the pickup and destination, the time, the car class, the extras booked and the Carrier's price; a Driver employed by a Carrier may be shown the order without the amount. The Passenger's name and contact details are shown once the order is accepted.

5.3. Acceptance. When the Carrier accepts an order, a contract of carriage on the terms shown is concluded between the Carrier and the Customer, which Let's GO concludes in the Carrier's name under section 6.

5.4. Who performs the trip. The Carrier performs the trip with a vehicle of the booked car class, or of a higher class where the order says so, and with a Driver registered in the Driver App for that Carrier. The Passenger is shown the Driver and vehicle who will come. Another Driver or vehicle of the same Carrier may perform the trip if the change is recorded by Let's GO, or by the Carrier in its account on the Let's GO website, before the pickup. Nobody who is not registered as the Carrier's Driver may perform a trip.

5.5. What the Customer booked. The Carrier provides the trip as booked: the car class, the stops, and the extras accepted with the order, such as a child seat, a pet or meeting the Passenger in the terminal.

5.6. Flights, waiting and no-show. For a booking with a flight, train or ship number, the booked pickup time is the arrival time the Customer gave. The Carrier may follow the actual arrival by its own means so that the Driver does not come earlier than needed. The free waiting time counts from the booked pickup time, whether or not the flight, train or ship is late, and never from an earlier arrival of the Driver. The Driver records in the Driver App, truthfully and at the moment it happens, the arrival at the pickup and, where the Driver App asks for it, the actual arrival time of the Passenger's flight, train or ship. A no-show may be recorded only after the free waiting time shown in the Driver App has passed with the Driver at the pickup. Recording an arrival, a waiting time or a no-show that did not happen is a serious breach.

5.7. Returning an accepted booking. The Carrier may return a booking it has accepted through the Driver App until the deadline shown there (Annex 2). After that deadline the Carrier may be released from a booking only for a serious reason, such as illness, an accident, a breakdown or force majeure, and must tell Let's GO at once so that another Driver can be found. Once a booking has become active, a few hours before the pickup, the Driver App may let the Driver cancel it; cancelling then without a serious reason is still a breach. How returned bookings count towards booking limits is described in Annex 2; it is not a penalty.

5.8. Changes and cancellations after acceptance. The Customer or a Let's GO dispatcher may change or cancel a booking, including one the Carrier has accepted. The Carrier is told in the Driver App, and the Carrier's price follows the changed Price under Annex 1. A Carrier that cannot perform the changed booking may return it in the Driver App or tell Let's GO, and doing so is not a breach.

5.9. Refusing or ending a trip. The Driver may refuse to start or may end a trip where continuing would put anyone at risk or break the law. The Driver tells Let's GO the reason through the Driver App or by e-mail on the same day.

5.10. Tolls. The price does not include road tolls. Where a route has them, the Passenger pays them to the Driver during or at the end of the trip. Tolls paid this way belong to the Carrier and are outside the collection and invoicing in sections 6 and 7; the Carrier deals with them for tax purposes.

5.11. No cash. Trips are paid only through Let's GO. The Driver does not accept cash or any other payment from the Customer for a trip, except road tolls under section 5.10.

5.12. Incidents and lost property. The Carrier tells Let's GO within 24 hours of any accident, injury, damage, serious incident or complaint connected with a trip, and cooperates in dealing with it. An item left in the vehicle is kept with reasonable care; the Carrier agrees directly with the Passenger, or through Let's GO, how it is returned.

5.13. Cars with a driver by the hour or by the day. Where the Customer books a car with a driver by the hour or by the day, the Carrier provides the car and the Driver for the whole time booked, counted from when the rental is started in the Driver App at the pickup. There is no set destination: the Driver takes the Passenger where the Passenger asks, within what the Carrier's Transport Licence allows and subject to section 5.9. Each day of a rental by the day is a shift of up to 10 hours, and the same Driver drives for the whole of that day. Time beyond 10 hours in a day is an extension of the rental, booked and charged to the Customer as the Passenger Terms provide and split under Annex 1; the Driver stays for it only within the working time and rest the law allows. Any other extension of the rental is treated the same way. If the Carrier ends a rental early for a reason other than those in section 5.9, the Carrier's price covers only the time used.

5.14. Service standards. Customers book a professional transfer, and the Carrier provides it to that standard: the vehicle is clean, in good repair and roadworthy, and no older than the age Let's GO sets for its car class (7 years at the date of this edition); the Driver is neat in appearance, and courteous and professional with Passengers. Meeting these standards is the Carrier's responsibility, and the Carrier decides how to meet them.

6. Mandate to conclude contracts and to collect the price

6.1. The mandate. The Carrier appoints Let's GO as its agent, acting in the Carrier's name and on its behalf, to:

  • (a) offer the Carrier's carriage to Customers through the Service at the price calculated under section 3.8;
  • (b) conclude the contract of carriage with the Customer when the Carrier accepts an order;
  • (c) collect from the Customer, through the Payment Provider, the Carrier's price, including the Carrier's part of any cancellation fee, no-show charge or waiting time the Customer owes under the Passenger Terms;
  • (d) make refunds to Customers in the cases in section 8.4 and, for that purpose, take the Carrier's price back from the Carrier's payout account as that section provides.

6.2. Payment to Let's GO is payment to the Carrier. A Customer who pays the Price through Let's GO or the Payment Provider has paid the Carrier its price, and owes the Carrier nothing further for that amount.

6.3. On whose behalf. In collecting the Carrier's price, Let's GO acts solely on behalf of the Carrier as the payee. The Let's GO commission, collected together with it in one payment, is Let's GO's own revenue.

6.4. Where the money goes. Customers' payments are processed by the Payment Provider. Let's GO instructs the Payment Provider to credit the Carrier's price in full to the Carrier's payout account without undue delay after the Customer is charged, and in any event within seven days. Let's GO does not use the Carrier's price for its own purposes. The seven days are for the credit to the payout account; when and how the money then reaches the Carrier's bank is governed by the Payment Provider's terms. This is without prejudice to section 6.5 for orders carried out without a payout account that is ready.

6.5. The payout account. To receive the Carrier's price for orders paid by card into it, the Carrier opens and keeps a payout account and completes the Payment Provider's identity checks online. Orders paid by card are also offered to a Carrier whose payout account is not yet ready. In that case Let's GO holds the Carrier's price for those orders on the Carrier's behalf, does not use it for its own purposes, and instructs its credit to the payout account within seven days of the account becoming ready. If the payout account is not ready within 90 days of the trip, Let's GO pays the amount by bank transfer to an account in the Carrier's name that the Carrier gives it in writing, within seven days of the Carrier doing so. The Payment Provider's own terms apply between the Carrier and the Payment Provider.

6.6. Changing the Payment Provider. Let's GO may change the Payment Provider. It tells the Carrier on a durable medium at least 15 days in advance, unless a faster change is required by law or by the previous Payment Provider ending its service, and the Carrier completes whatever the new Payment Provider needs to open a payout account.

6.7. Payments that fail. Let's GO does not guarantee that a Customer pays. If a Customer's payment fails after a trip, Let's GO pursues it on the Carrier's behalf, and the Carrier's price is paid when the payment is received.

7. Invoices issued in the Carrier's name

7.1. The mandate to invoice. As Article 220(1) of Council Directive 2006/112/EC and the national rules named in the Country Terms allow, the Carrier consents to, and instructs, Let's GO issuing in the Carrier's name and on its behalf the invoice for the Carrier's price of each trip and for the Carrier's part of each cancellation fee, no-show charge or waiting time charged to a Customer, and sending it to the Customer. This includes simplified invoices, full invoices when the Customer asks for one or the law requires it, and corrective invoices.

7.2. What the invoice says. Each invoice complies with the invoicing law of the country named in the Country Terms. It shows the Carrier as the issuer, with its name, tax number and tax address; the Customer where the law requires it; the service; the taxable amount, the VAT rate and the VAT; and a statement that it was issued by Let's GO in the Carrier's name and on its behalf. It is issued for the Carrier's price.

7.3. Numbering. The invoices Let's GO issues for the Carrier carry a series reserved for that Carrier, numbered in order. Corrective invoices carry a series of their own.

7.4. Sending. Once the Customer has paid, Let's GO sends the Customer by e-mail, together:

  • (a) the Carrier's invoice under this section;
  • (b) Let's GO's own invoice for the Let's GO commission under section 7.12;
  • (c) a receipt, which is not an invoice, showing the Price paid and how it is split between the Carrier's price and the Let's GO commission, and naming the Carrier.

Let's GO sends the Carrier a copy of the Carrier's invoice by e-mail. The Carrier agrees to receive its copies electronically, and to its name and its price being shown to the Customer in the invoice and the receipt.

7.5. Tax details. The Carrier gives Let's GO its correct tax details and VAT position at Registration, and updates them within five days of any change. Let's GO applies the VAT treatment that the Country Terms give for passenger transport, unless the Carrier tells it in writing, with the legal reason, that a different treatment applies. The Carrier is responsible for the tax treatment and for any error caused by the details it gave. While the Carrier's tax details are incomplete, Let's GO does not issue invoices in the Carrier's name.

7.6. Checking the invoices. The Carrier may object to an invoice within 15 days of receiving its copy. Where the objection is justified, Let's GO issues a corrective invoice. An invoice not objected to within that period is taken as accepted, without prejudice to any correction the law requires.

7.7. The Carrier remains the taxpayer. The Carrier remains responsible for its tax obligations, including declaring and paying the VAT charged on its invoices and keeping its tax records. Let's GO does not file the Carrier's tax returns.

7.8. Records. Let's GO keeps the invoices it issues for the Carrier for at least the period tax and commercial law require, and gives the Carrier, and any authority that lawfully asks, access to them.

7.9. Electronic invoicing systems. Let's GO's invoicing system will meet the requirements for electronic invoicing and for invoicing software that apply to the Carrier. The Carrier authorises Let's GO to generate and, where the rules require it, to send to the tax authority the invoicing records of the invoices Let's GO issues in the Carrier's name.

7.10. Where the mandate cannot be used. If the Country Terms or another legal reason prevent Let's GO from invoicing in the Carrier's name, the Carrier tells Let's GO at Registration or as soon as it knows; in that case the Carrier issues its own invoices and Let's GO gives it the trip details it needs.

7.11. No duplicate invoices. The Carrier does not issue its own invoice for a trip that Let's GO has invoiced in its name.

7.12. Let's GO's own invoice. For the Let's GO commission, Let's GO issues its own invoice to the Customer, in its own name, with the VAT that applies to it. That invoice is not the Carrier's invoice and does not change the Carrier's price. Let's GO issues no invoice to the Carrier for trips.

7.13. The mandates are essential. The mandates in sections 6 and 7 are an essential part of this Agreement and last as long as it does. If the Carrier revokes either of them, this Agreement ends under section 13.

8. Money

8.1. How the Price is split. The Price is split into the Carrier's price and the Let's GO commission as set out in Annex 1. The split that applies to a trip is the one in force when the Carrier accepted the order.

8.2. Cancellation, no-show and waiting. Where a Customer owes a cancellation fee, a no-show charge or waiting time under the Passenger Terms, the amount is split in the same way: the Carrier's part is invoiced in the Carrier's name and paid to the Carrier in full, and the Let's GO commission is invoiced by Let's GO. Whether such an amount is due is decided under the Passenger Terms in force and the trip's records; the Carrier may ask for a review under section 15.

8.3. What the Carrier pays. Let's GO charges the Carrier nothing: the Let's GO commission is paid by the Customer, and there is no sign-up fee, no subscription and no charge for the Driver App. Let's GO bears the Payment Provider's fees for processing Customers' payments. Any fee the Payment Provider charges the Carrier directly under its own terms is the Carrier's.

8.4. Refunds. Let's GO may refund a Customer, in the Carrier's name as to the Carrier's price and in its own name as to the Let's GO commission, where a trip was not performed or not performed as booked, where an amount was charged in error, or where the law requires a refund. Where the Carrier's price for that trip has already been paid into the Carrier's payout account, Let's GO takes it back from that account through the Payment Provider and tells the Carrier why. If the money has already left the payout account, the part not taken back is owed by the Carrier where the Carrier or its Driver cancelled the trip, and is borne by Let's GO in every other case. A Carrier that considers the refund was not due to it may ask for a review under section 15; where the review confirms that, Let's GO pays the Carrier's price back. Each refund is documented by a corrective invoice from the party whose invoice it corrects.

8.5. Reversed payments. When a Customer's bank disputes a payment, the Carrier gives Let's GO, within the time Let's GO indicates, the information it has about the trip. Let's GO bears the outcome of the dispute, and the Carrier keeps its price.

8.6. Amounts owed. Apart from taking back a Carrier's price under section 8.4, Let's GO deducts nothing from what it pays the Carrier. If the Carrier owes Let's GO an amount under this Agreement, such as under section 8.4 or 11.5, Let's GO claims it by a debit note, which is not an invoice, and the Carrier pays it within 15 days.

8.7. Taxes. Each party bears its own taxes.

9. Automated tools, ratings and location

9.1. What is automated. Let's GO uses automated systems to offer orders, to set how many bookings a Driver can hold, to end a shift when the telephone has stopped responding, to check that a payout account is ready, and to calculate the average rating. Annex 2 describes each one, the main parameters it uses and their relative importance.

9.2. Decisions taken by a person. Apart from the technical conditions described in Annex 2, no decision to restrict, suspend or end the access of a Carrier, a Driver or a vehicle is taken by an automated system alone: it is taken by a person at Let's GO.

9.3. Ratings. Customers may rate a trip from 1 to 5. The Driver's average is shown to the Driver in the Driver App and is not shown to Customers. Let's GO does not use ratings automatically to offer orders, to set limits or to restrict access; a person at Let's GO may look at them when reviewing a complaint.

9.4. Explanation and review. The Carrier or the Driver may ask Let's GO to explain any decision described in Annex 2 or any decision to restrict or suspend, and to have it reviewed by a person. Let's GO answers in writing within two weeks.

9.5. Location. The Driver App collects the vehicle's location while the Driver is online and during a trip, including when the app is in the background. Let's GO uses it to offer nearby orders, to show the vehicle to the Customer, to record waiting and arrival, for safety, and to resolve disputes and complaints. It is not collected while the Driver is offline and is not used to assess how the Driver works.

9.6. Messages. Messages between the Driver and the Passenger in the Driver App are kept as the Privacy Policy sets out. Let's GO staff who handle bookings can see them in the booking's record and use them only to deal with a complaint, a dispute about a trip, an incident, a suspicion of fraud or a request from an authority. They are not used to assess how the Driver works.

10. Personal data, tax reporting and confidentiality

10.1. Data about the Carrier and its Drivers. Let's GO is the controller of the personal data of the Carrier and its Drivers that it processes to provide the Service. What it collects, why, on what legal basis, for how long, who receives it and how to exercise data protection rights is set out in the Let's GO Privacy Policy, available in the Driver App. The Carrier gives its Drivers that information as their employer; Let's GO also makes it available to them in the Driver App.

10.2. Data about Customers. The Carrier is a separate controller of the personal data of Customers and Passengers it receives for a trip. It uses that data only to perform the trip, to return lost property and to meet its legal obligations. It does not use it for marketing, does not pass it to anyone else and does not keep it longer than those purposes need.

10.3. Reporting to tax authorities. Council Directive (EU) 2021/514 (DAC7), as implemented in the country where Let's GO is established, requires Let's GO to collect and verify information about each Carrier and to report it each year to the tax authority, which may exchange it with the tax authorities of other countries. The information is the Carrier's name, address, tax identification number, date of birth (for an individual), VAT number and business registration number (for a company), the account into which it is paid where Let's GO has it, the amounts paid or credited to the Carrier in each quarter, and any fees or commissions Let's GO withheld from or charged to the Carrier. The Carrier gives it at Registration and keeps it up to date. If the Carrier does not give it after two reminders, and not earlier than 60 days after the first request, Let's GO may suspend access and withhold payment of the Carrier's price until it does, as that Directive requires.

10.4. What the Carrier can see. In the Driver App the Carrier and its Drivers can see the orders offered and accepted, their trips, their earnings history and their average rating; copies of the invoices issued in the Carrier's name are sent by e-mail. Let's GO does not give the Carrier data about other Carriers or aggregated data about the Service. After this Agreement ends, the Carrier may ask for copies of its invoices and trip records for as long as Let's GO keeps them.

10.5. Accounts. Each Driver has their own account in the Driver App and keeps its access to themselves. An account is not shared or lent.

10.6. Confidentiality. Each party keeps confidential the other's non-public business information it learns through this Agreement, during its term and for two years after.

10.7. The Driver App. Let's GO grants the Carrier and its Drivers a personal, non-exclusive, non-transferable licence to use the Driver App for the purposes of this Agreement while it lasts. The Carrier does not copy, modify or reverse-engineer it. The Carrier authorises Let's GO to show Customers its name, and the Driver's name, photograph, vehicle and plate, for the trips it accepts. This Agreement does not transfer any intellectual property of the Carrier to Let's GO.

11. Liability

11.1. The Carrier's liability. The Carrier is liable to Customers, Passengers and third parties for the trips it performs, for its vehicles and its Drivers, and for its compliance with the law.

11.2. Let's GO's liability. Let's GO is liable for performing its own obligations under this Agreement: offering orders, collecting, paying the Carrier's price and issuing invoices as set out here. It is liable only for direct damage caused by its breach, and not for loss of profit, loss of orders or indirect damage. Its total liability to the Carrier in any twelve months is limited to the Let's GO commission charged on that Carrier's trips in the twelve months before the event. This limit does not apply to paying the Carrier's price that Let's GO has collected.

11.3. What is never limited. Nothing in this Agreement limits the liability of either party for wilful misconduct or gross negligence, for death or personal injury, or where the law does not allow liability to be limited.

11.4. Availability. Let's GO does not promise that the Service is available without interruption. It may stop accepting new bookings across the Service for a time, for technical or operational reasons; trips already accepted continue.

11.5. Indemnity. The Carrier indemnifies Let's GO against any claim, fine, sanction, damage or reasonable cost that Let's GO suffers because of: a trip the Carrier performed; the lack of any Transport Licence, driving licence, permit, inspection or insurance; information given at Registration that was untrue; the Carrier's breach of its tax, social security or employment obligations, including a claim by a Driver the Carrier employs that asserts an employment relationship with Let's GO; or the Carrier's misuse of personal data. Let's GO tells the Carrier promptly of any such claim and lets it take part in the defence.

11.6. Insurance. The Carrier's insurance responds first for everything connected with its trips. Let's GO is not the Carrier's insurer.

12. Changes to this Agreement

12.1. Notice. Let's GO may change this Agreement, including its Annexes. It tells the Carrier on a durable medium at least 15 days before a change takes effect, or longer where the change requires the Carrier to make technical or commercial adjustments, and explains what changes.

12.2. The Carrier's choice. A Carrier that does not agree may end this Agreement at any time before the change takes effect, at no cost.

12.3. Accepting a new edition. From the date a new edition takes effect, it must be accepted in the Driver App before going online. Where the Driver App offers it, the Carrier may accept a new edition earlier, during the notice period.

12.4. Exceptions. The 15-day notice does not apply where a change is required by law or by an authority in a shorter time, or where it is needed to deal with an unforeseen and imminent risk of fraud, malware or a threat to safety or security.

12.5. No retroactive changes. A change never applies to trips already performed, and a change to Annex 1 applies only to orders accepted after it takes effect.

12.6. New countries. Adding Country Terms for a new country does not change the terms for trips in countries already covered, and does not require a Carrier that does not work in the new country to accept anything.

13. Suspension and ending the Agreement

13.1. By the Carrier. The Carrier may end this Agreement at any time, with immediate effect, by notice in the Driver App, by e-mail to info@letsgo-transfer.com or by deleting its account. It returns in the Driver App, or tells Let's GO about, the bookings it has accepted but will not perform, so that they can be offered to other Carriers.

13.2. By Let's GO, with notice. Let's GO may end this Agreement by giving the Carrier at least 30 days' notice on a durable medium, with the reasons.

13.3. Restriction, suspension or immediate termination. Let's GO may restrict or suspend the access of the Carrier, of one of its Drivers or of one vehicle, or end this Agreement with immediate effect, where:

  • (a) a required licence, permit, inspection, insurance or document is missing, expired, suspended or false, or information given at Registration is untrue;
  • (b) the Carrier or a Driver commits a serious breach, or repeated breaches, of this Agreement, such as recording an arrival, waiting time or no-show that did not happen, fraud, violence, harassment or discrimination against a Passenger, driving under the influence of alcohol or drugs, a trip performed by a person or vehicle not registered for the Carrier, sharing an account, or misusing Customers' data;
  • (c) the law or an authority requires it; or
  • (d) there is a reasonable suspicion of fraud or of a risk to the safety of Passengers or others, for the time needed to look into it, which Let's GO does without delay.

13.4. Reasons. Let's GO tells the Carrier, on a durable medium and at the latest when the measure takes effect, what it has decided and why, with the specific facts and the ground in this Agreement, unless the law or an authority prevents it. The decision is taken by a person at Let's GO.

13.5. Clarifying and reinstating. The Carrier may respond and ask for a review under section 15. If the review shows the measure was not justified, Let's GO lifts it without undue delay.

13.6. A measure on the Carrier covers its Drivers. Suspending or ending the Carrier's access suspends or ends the access of all its Drivers.

13.7. What happens on ending. Bookings accepted and not yet performed may be offered to other Carriers. Let's GO pays the amounts owed to the Carrier. The mandates in sections 6 and 7 end, except for completing the collection and invoicing of trips already performed. Sections 7.7, 7.8, 8, 10, 11, 15 and 17 continue to apply.

14. Drivers who drive for a Carrier

14.1. Two ways to register. At Registration each person states whether they hold the Transport Licence for the vehicle they will drive.

  • (a) A person who holds it registers as a Carrier and, where they drive themselves, also as their own Driver.
  • (b) A person who drives for a holder registers as that holder's Driver. Either the holder registers in the Driver App as a Carrier and adds the person as its Driver, or the person gives the holder's name and tax number and uploads in the Driver App, or sends to info@letsgo-transfer.com, the Carrier's confirmation on the form available in the Driver App or from that address, signed by the holder or its representative. By that confirmation the holder accepts this Agreement as Carrier, confirms that it employs the person, authorises them to accept orders in its name and, if it wishes, designates the account under section 14.4. Let's GO may write to the holder at the contact details in the confirmation to check it.

No order is offered to a person registering under (b) until one of these is done.

14.2. Who may be a Driver. A Carrier registers as its Drivers only itself, where it is an individual who drives, and persons it employs.

14.3. The Carrier is the employer. The Carrier alone is the employer of the Drivers it employs. It pays their wages and social security contributions, sets their working time within the limits of the law, ensures their rest, and meets its duties on health and safety at work. Let's GO has no employment relationship with them.

14.4. Payments for its Drivers' trips. Trips performed by the Carrier's Drivers are the Carrier's trips: they are invoiced in the Carrier's name and the Carrier's price is paid into the Carrier's payout account. The Carrier may instead designate, in the Driver App or in the confirmation under section 14.1(b), the payout account of one of its Drivers to receive the payments for that Driver's trips on the Carrier's behalf; a payment into that account is then a payment to the Carrier, and the Carrier and its Driver settle it between themselves.

14.5. What a Driver accepts. A Driver who is not the Carrier confirms, when accepting this Agreement in the Driver App, that they are employed by the Carrier and authorised by it to accept orders in its name, and agrees to sections 3.2, 4.1(b), 4.1(g), 5, 9, 10 and 13 as the rules for their use of the Driver App. The Driver is not a party to the commercial terms between Let's GO and the Carrier.

14.6. The Carrier answers for its Drivers. The Carrier is responsible to Let's GO for everything its Drivers do or fail to do in connection with trips and the Driver App.

14.7. A Driver who leaves. The Carrier tells Let's GO at once when a Driver stops working for it, and Let's GO removes that Driver from the Carrier's account. Bookings accepted by that Driver remain the Carrier's bookings.

15. Complaints and disputes

15.1. Complaints and reviews. The Carrier or a Driver may complain about any matter under this Agreement, or ask for a review of a decision, by e-mail to info@letsgo-transfer.com. A person at Let's GO looks into it and answers in writing within two weeks. Using this procedure costs nothing and does not prevent going to court.

15.2. Mediation. The parties may agree to try mediation before going to court.

15.3. Applicable law. This Agreement is governed by Spanish law, without prejudice to the rules of the country where a trip takes place that cannot be excluded by agreement, including its rules on transport licences, taxes and employment.

15.4. Jurisdiction. To the extent the law allows the parties to choose the courts, the courts of the city of Barcelona have jurisdiction over any dispute about this Agreement. Where it does not, the courts the law designates have jurisdiction.

16. Force majeure

16.1. Neither party is liable for failing to perform, or for performing late, where the cause is an event beyond its reasonable control that it could not foresee or, if foreseeable, could not avoid, such as a natural disaster, extreme weather, an epidemic, war, terrorism, a decision of an authority, a general strike, the closure of roads, airports or ports, or a general failure of telecommunications, electricity, payment or hosting services.

16.2. The party affected tells the other without delay and does what it reasonably can to limit the effects. If the event lasts more than 30 days, either party may end this Agreement by notice.

16.3. Force majeure never excuses paying an amount already collected or already due.

17. General provisions

17.1. Notices. Let's GO sends notices to the Carrier in the Driver App and to the e-mail address registered there. The Carrier sends notices in the Driver App, to info@letsgo-transfer.com or to the office address in section 1.1. info@letsgo-transfer.com is also Let's GO's single point of contact for users and authorities under Regulation (EU) 2022/2065 (Digital Services Act), in Spanish, Catalan, English, French, German or Russian.

17.2. Transfer. The Carrier may not transfer this Agreement without Let's GO's written consent. Let's GO may transfer it to a company that takes over the Service, telling the Carrier on a durable medium in advance; the Carrier may then end this Agreement under section 13.1.

17.3. Whole agreement. This Agreement, with its four Annexes, is the whole agreement between the parties about the Service and replaces any earlier text shown in the Driver App.

17.4. Severability. If a provision is held invalid, the rest of this Agreement remains in force, and the parties replace the invalid provision with a valid one as close as possible to its purpose.

17.5. No waiver. Not exercising a right is not a waiver of it.

17.6. Language. This Agreement is available in several languages. Let's GO is a Spanish company, and if the versions differ, the Spanish version prevails in every country.

18. Transition from the earlier terms

18.1. Carriers and Drivers already registered. Let's GO sends this edition to Carriers and Drivers already registered, on a durable medium, at least 15 days before it takes effect. A Carrier or Driver registered before this edition takes effect accepts it before going online. Within 30 days of accepting, it completes the information and documents in Annex 3 and the Country Terms, and a Driver who does not hold the Transport Licence provides the Carrier's confirmation under section 14.1(b). Orders continue to be offered during those 30 days; after them, section 4.5 applies. Until the Carrier's confirmation is given, payments for the trips of a Driver who does not hold the Transport Licence are made into that Driver's payout account on the Carrier's behalf, as section 14.4 allows.

18.2. When invoicing in the Carrier's name starts. Let's GO starts issuing invoices in the Carrier's name under section 7 on a date it announces to the Carrier on a durable medium at least 15 days in advance. Until that date, sections 7.1 to 7.4, 7.11 and 7.12, the last sentence of section 8.4 and point 3 of Annex 1 do not apply: the Carrier issues its own invoices for its trips as the law requires, and Let's GO gives it the trip details it needs to do so.

Annex 1. Let's GO commission

1. The Price is split into two parts: the Carrier's price, 80%, and the Let's GO commission, 20%. The same split applies to extras, to the extension of a rental and time beyond a day's shift, and to any cancellation fee, no-show charge or waiting time.

2. Each part includes the VAT that applies to it. For a trip in Spain, the Carrier's price includes VAT at the rate for passenger transport (10% at the date of this edition), unless the Carrier has stated a different treatment under section 7.5, and the Let's GO commission includes Spanish VAT (21% at the date of this edition).

3. After payment the Customer receives two invoices, the Carrier's invoice for the Carrier's price, issued by Let's GO in the Carrier's name, and Let's GO's invoice for the Let's GO commission, together with one receipt showing the Price and its split. The Carrier receives a copy of its invoice and the Carrier's price in full. Nothing is invoiced to the Carrier.

4. Trips are paid only through Let's GO; there are no trips paid in cash (section 5.11).

5. Let's GO may agree a different split with a particular Carrier in writing.

6. Example, for a trip in Spain whose Price is 100.00 EUR, at the VAT rates in force at the date of this edition:

  • the Customer pays 100.00 EUR in one payment;
  • the Carrier's invoice, issued by Let's GO in the Carrier's name: 80.00 EUR (taxable amount 72.73 EUR, VAT at 10% 7.27 EUR);
  • Let's GO's invoice: Let's GO commission 20.00 EUR (taxable amount 16.53 EUR, VAT at 21% 3.47 EUR);
  • the receipt: Price 100.00 EUR = Carrier's price 80.00 EUR + Let's GO commission 20.00 EUR;
  • the Carrier receives 80.00 EUR into its payout account.

Annex 2. How orders, limits and the other automated tools work

The figures in this Annex are those in force at the date of this edition. Let's GO changes them only under section 12.

1. Offers of immediate orders. An order is offered to one Driver at a time, starting with the online Driver nearest to the pickup, within 50 km of it. Each Driver has 30 seconds to accept or decline before the order goes to the next. The main parameters, in order of importance, are: that the Driver is online and not on another trip, the car class and the distance from the pickup. Ratings, nationality and any other personal characteristic are not used. An order a Driver has declined or returned is not offered to that Driver again.

2. Available orders. At the same time, orders, bookings included, are listed among the available orders in the Driver App, where any Driver of the right car class may accept them, subject to the booking limits below. The first Driver to accept takes the order.

3. Booking limits. So that Passengers do not lose rides when one Driver gives back many bookings at once, the number of bookings a Driver can hold is limited:

  • per calendar day of pickup: a base of 3;
  • open at the same time: a base of 10;
  • no more than 5 bookings accepted in any rolling hour.

The bases may be adjusted to what Drivers actually do, as the level that nine out of ten working days stay within over the last 180 days, and are kept between 2 and 12 per day and between 5 and 40 open. Each Driver's bases are multiplied by a personal factor calculated from the last 180 days:

factor = 1 + (bookings completed - 3 × weight of bookings returned) / 20, kept between 0.5 and 3.

A booking returned 48 hours or more before the pickup weighs 1; the weight rises gradually to 2 as the return gets closer to the pickup. A Driver with no history has a factor of 1. Bookings beyond the limit are simply not shown to that Driver; a limit never takes away a booking already accepted. A Let's GO dispatcher may set a different limit for a Carrier or a Driver. Any Driver may ask for their current figures and an explanation under section 9.4.

4. Returning a booking. A booking accepted by the Carrier may be returned through the Driver App up to 12 hours before the pickup; after that, section 5.7 applies.

5. Ending a shift. If the Driver's telephone stops responding for 6 hours in a row, the shift ends automatically. The Driver may go online again at any time.

6. Payout account. Orders paid by card are offered to Drivers of the right car class whose documents Let's GO has reviewed under section 4.3, whether or not their payout account is ready. If it is not, the Carrier's price is paid as set out in section 6.5.

7. Bookings not yet paid. A booking that a Customer is to pay in advance by a payment link may be accepted by a Driver before it is paid, but the trip does not start until it is paid.

8. Ratings. The average rating is the average of the Customers' ratings from 1 to 5. A Driver with no ratings is shown 4.0. The rating has no automatic effect on offers, limits or access.

9. Price. The Price shown to the Customer, and the Carrier's price shown in each offer, are calculated from the route between the addresses, the expected journey time, the car class and the extras booked; for a car with a driver by the hour or by the day, from the hourly or daily price of the car class and the time booked. They do not change during the trip unless the Customer changes the trip.

10. Other automatic rules. A booking that overlaps in time, travel time included, with one the Driver already holds is refused. A booking the Driver holds that starts within the next 2 hours keeps immediate orders and rentals from being offered to that Driver. A Driver on a trip is offered only bookings. The same order is offered to the same Driver no more than 3 times. Pickups outside Spain are not accepted. A booking that no Driver has taken is offered to Drivers one at a time from a few hours before the pickup.

Annex 3. Registration: the information and documents asked for

Everything is given in the Driver App, or by e-mail where section 4.3 allows. Items marked in the Country Terms as required for a country are required for trips there.

1. About the Carrier:

  • whether it is an individual or a company;
  • full name, or company name and registration number;
  • tax identification number, and VAT number where it has one;
  • date of birth (individuals);
  • address of residence or registered office, and the country where it is resident for tax purposes;
  • its VAT position and tax regime for the activity;
  • its social security position: self-employed, employer, or both;
  • the Transport Licence: number, issuing authority, holder, and the vehicles it covers;
  • an e-mail address and a mobile telephone number;
  • for a company: its legal representative and the document showing their authority.

2. About each Driver:

  • full name, and an identity document (type, number and a photograph of it);
  • driving licence: number, class and expiry date, and a photograph of it;
  • a photograph for Passengers;
  • whether they are the Carrier or employed by the Carrier.

3. About each vehicle:

  • make, model, colour, year and registration plate;
  • the registration certificate;
  • the date of the next roadworthiness inspection;
  • the insurance: insurer, policy number and expiry date, and the policy or certificate.

4. The declarations: that the information is true and complete, that the Carrier meets section 4.1, and, where the Country Terms require it, the declaration of economic independence.

5. The Payment Provider asks separately, in its own online process, for what it needs to open a payout account.

Annex 4. Country Terms

Country Terms: Spain

1. Transport Licence. The authorisation for the hire of vehicles with driver (autorización de arrendamiento de vehículos con conductor, VTC), which is issued for each vehicle. The Carrier also complies with any additional requirement of the autonomous community or municipality where a trip starts.

2. Insurance and inspection. The compulsory motor insurance (seguro obligatorio de automóviles), the compulsory travellers' insurance (Seguro Obligatorio de Viajeros) where it applies, civil liability insurance, and a current ITV.

3. Registrations. Registration with the Spanish Tax Agency for the activity, and with Social Security in the self-employed regime (RETA) or as an employer.

4. Additional documents at Registration: the VTC authorisation for each vehicle (the document the authority issued, showing the holder and the plate); a current certificate of tax registration (certificado de situación censal); proof of registration with Social Security; the current ITV; the insurance policy and proof of payment.

5. Invoicing. The mandate in section 7 is given under article 5 of the Invoicing Regulation approved by Royal Decree 1619/2012. The invoices carry a series reserved for invoices issued by a third party. Passenger transport is taxed at the reduced VAT rate of article 91.Uno.2.1º of Law 37/1992 (10% at the date of this edition). Royal Decree 1007/2023 on invoicing systems applies from the date it becomes binding on the Carrier. A Carrier subject to the tax regime of the Basque Country or Navarre states it at Registration, and section 7.10 applies until Let's GO can invoice under that regime.

6. Economic dependence. The Carrier declares that its income from trips through Let's GO is not, and is not expected to become, 75% or more of its income from work or business activity, so that it is not an economically dependent self-employed worker (TRADE) under article 11 of Law 20/2007. If that changes, it tells Let's GO in writing without delay.

7. Contracting electronically. Articles 27 and 28 of Law 34/2002 (LSSI-CE) are excluded as section 1.6 provides.

8. Agency. This Agreement is not a commercial agency contract under Law 12/1992.

9. Complaint forms. The Carrier keeps in the vehicle the official complaint forms (hojas de reclamaciones) that the consumer rules of the autonomous community require, and gives one to a Passenger who asks.
